This consultation paper, issued by the Civil Justice Council (CJC) recognises that within the civil courts there are individuals who may be vulnerable because of mental health problems (including learning difficulties). (Clearly this group does not include claimants or defendants who have ‘protected party’ status). There are well established safeguards in place already in criminal cases, particularly for vulnerable witnesses. More recently, the issue of vulnerability has been addressed in detailed measures in the family courts.
