FOIL Update – Setting off costs in a case subject to QOCS

In an Update dated 25 November 2019 (available on the FOIL members’ website), we reported the judgment of the Court of Appeal in this case, which decided that the claimant/respondent was only entitled to the costs provided by the fixed recoverable costs’ regime (FRCS) and the parties had not contracted out of the FRCS. The claim was brought in 2014 under the RTA Portal Protocol but left the portal when the defendant/appellant did not admit liability.
