FOIL members had raised concerns at the challenges presented by witnesses on video, including the difficulties this creates in judging a witnesses’ body language and demeanour; concerns that the evidence from a witness from home may be influenced by a third party; and privilege, DPA, and confidentiality issues arising from e-bundles being sent to witnesses for use at the hearing. As a result, FOIL made representations to HHJ Bird in Manchester and HHJ Wood in Liverpool, asking that consideration be given to hybrid trials with the judge and the witnesses in person and the advocates on video. Whilst not ideal, it addresses some of the issues mentioned above.
