A Deputy High Court Judge had awarded damages totalling £406,688 but had assessed future loss of earnings by way of a lump-sum Blamire award, with a Smith v Manchester award in respect of disadvantage on the open labour market. The claimant appealed and submitted that the judge could and should have quantified damages for loss of earnings by making a conventional award based on the adoption of a multiplier and multiplicand. The defendant/respondent resisted the appeal and cross-appealed, contending that the judge applied the wrong test of causation to the losses flowing from an apparent redundancy leading to the future loss of earnings Blamire award.
