In section 10 of its judgment, the Court of Appeal set out its views on the right approach to costs assessment. The court was anxious not to restrict judges or force them, when assessing a bill of costs, to follow inflexible or overly-complex rules. One of the matters, however, which was apparent from the many cases cited to during the course of this hearing and from the submissions of counsel in these appeals, was that there was an absence of consistency in the way in which costs bills are assessed. The Court of Appeal gave the following guidance on an appropriate approach.
