In allowing the defendants’ applications for an extension of time for serving evidence, leading to an adjournment of a hearing, a judge in the Technology and Construction Court gave guidance on the court’s approach to such applications during the coronavirus pandemic. Overall, this was a comprehensive judgment and consideration should be had to the principles set out below when making applications for adjournments or extensions of time during this time as they may be applicable irrespective of the type of case involved.
